Terms of Service

Zeke AI is an AI media-buying and knowledge platform for performance marketing agencies. Using it means you agree to the terms below. We've written them in plain English. If anything reads like it's trying to trick you, email legal@usezeke.com and we'll rewrite it.

• You pay us; we run Zeke for you.
• You own your data. We never sell it, share it for marketing, or train models on it.
• We don't take actions on your ad accounts without your explicit approval.
• Cancel any time. 30-day money-back on your first month.
• Price locked forever — your sign-up price is yours as long as you stay.

Zeke AI is operated by McKit Solutions LLC, a Delaware limited liability company. When these Terms refer to “we,” “us,” or “Zeke,” we mean McKit Solutions LLC. When they refer to “you” or “your,” we mean the person or organization using Zeke — typically a performance marketing agency or in-house marketing team.

Our operating domain is usezeke.com. All support flows through hello@usezeke.com.

Zeke connects to your Meta Business Manager and Google Ads MCC accounts (with your OAuth authorization), synthesizes performance data, generates daily recommendations, and lets you approve, dismiss, or reject each rec. Zeke also ingests documents you upload (SOWs, call notes, playbooks, etc.), extracts typed knowledge shards, and makes them searchable.

Zeke never takes write actions on your ad accounts without your explicit click-through approval. You control every action.

You're responsible for keeping your account credentials secure. If you invite teammates, you're responsible for their access — revoke it when they leave.

You must be 18 years or older and authorized to bind your organization to these Terms.

Subscription feesare billed in advance. Monthly subscriptions renew monthly; annual subscriptions renew yearly. Your sign-up price is locked — we won't raise it on you even if we raise prices for new customers.

30-day money-back guarantee: if you cancel within 30 days of your first charge, we refund the full first-month (or pro-rated annual) payment. No questions, no guilt trip. Email us the request.

Cancellation: cancel any time in Settings → Billing or by emailing hello@usezeke.com. Monthly cancellations take effect at the end of your current billing period. Annual cancellations don't auto-refund unpaid months unless you're within the 30-day window.

Payment processingis handled by Stripe. Your card details never touch Zeke's servers.

You own everything you upload, generate, or feed into Zeke. That includes your Meta + Google data, documents, knowledge shards, AI-generated recommendations, rejection reasons, and audit logs.

We never:

• Sell your data to anyone.
• Share it with third parties for marketing purposes.
• Train AI models on your content, your uploads, or your approval/rejection patterns.
• Read your data for any purpose other than running Zeke for you and responding to support requests you initiate.

We do send your content to third-party AI providers (Anthropic for reasoning, OpenAI for embeddings) to generate recommendations and extract shards. These providers are bound by contracts that prohibit training on your data. See the Data Processing Addendum for details.

You can export or delete your data at any time from Settings. Deleted data is purged within 30 days.

Don't use Zeke to:

• Violate Meta, Google, or any other platform's terms of service.
• Run ads for content that's illegal, deceptive, or harmful (including but not limited to: unregistered financial products, deepfake content depicting real people without consent, or anything promoting violence).
• Attempt to reverse-engineer Zeke's models, prompts, or infrastructure.
• Resell Zeke access unless your subscription tier includes reseller rights (Scale tier and above).
• Interfere with other customers' use of the product.

We reserve the right to suspend accounts that violate these terms. We'll give you notice and a chance to cure before suspending, except in egregious cases (e.g., fraud, active security threat).

Zeke generates recommendations using large language models. We work hard to make them accurate and useful, but they're probabilistic, not deterministic. You're the final decision-maker on every action Zeke suggests.

We do not guarantee specific performance outcomes from following Zeke's recommendations. Advertising outcomes depend on many factors outside our control (market conditions, creative quality, platform algorithm changes, etc.).

We target 99.9% monthly uptime for the core product. We don't commit to a hard SLA on the Starter or Growth tiers. Scale and Custom tiers include a 99.9% SLA with service credits for downtime beyond that threshold.

Scheduled maintenance windows are announced at least 48 hours in advance via email and the in-app status page.

You can cancel any time with no termination fee. We can terminate your account for (a) unpaid invoices beyond 30 days, (b) material violation of the Acceptable Use section, or (c) legal requirement. We'll give notice and opportunity to cure except for (c).

When your account terminates, you have 30 days to export your data. After that, we delete it.

To the maximum extent permitted by law, our total liability for any claim related to Zeke is capped at the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, consequential, or lost-profits damages.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud.

You agree to indemnify McKit Solutions LLC for claims arising from your misuse of Zeke, your violation of these Terms, or your infringement of third-party rights (including platform terms of service on Meta, Google, etc.).

We'll defend you against third-party claims alleging that Zeke itself infringes a US patent, copyright, or trademark — provided you notify us promptly and let us handle the defense.

These Terms are governed by the laws of the State of Delaware, USA. Disputes not resolved informally within 60 days are subject to binding arbitration in the state of Delaware, with each party bearing its own costs.

You waive the right to participate in class actions against us.

We may update these Terms as Zeke evolves. For material changes, we'll email you at least 30 days before they take effect. Continued use after the effective date means you accept the updated Terms.

If you don't like the updated Terms, cancel and we'll refund any unused portion of your current billing period.
